These Terms & Conditions apply to purchases made through the online store operated by Bené Rodrigues.
By placing an order through this website, you agree to these Terms & Conditions.

2. Products and original artworks
Each original artwork is an individual, unique work of art.
Original artworks may contain natural variations, visible brushwork, texture, surface irregularities and other characteristics resulting from the artistic process. These characteristics are part of the artwork and are not considered defects.
Colours may appear differently depending on the customer's screen, device and display settings.
Artwork dimensions, materials and other product information are provided on the relevant product page.
Because original artworks are unique, the exact artwork shown on the product page is the artwork supplied to the customer.
3. Prices and payment
All prices are displayed in the currency indicated on the website.
Where applicable, taxes and VAT are included in the displayed price.
Payment must be completed before an order is processed and shipped.
Available payment methods are displayed during checkout.
An order is considered accepted once payment has been successfully received and the order has been confirmed.
4. Availability
Original artworks are available only while they remain in stock.
Because original artworks are unique, an artwork cannot normally be replaced with an identical item if it becomes unavailable.
If an order cannot be fulfilled after payment has been received, the customer will be informed and the amount paid for the unavailable item will be refunded.
5. Shipping and delivery
Shipping information, available destinations, estimated delivery times and shipping costs are provided during the purchasing and checkout process.
The artist currently ships artworks from France.
The customer is responsible for providing a complete and accurate delivery address and telephone number.
Delivery times are estimates and may be affected by circumstances outside the artist's reasonable control, including carrier delays, customs procedures and other events beyond the artist's control.
For international shipments, the customer is responsible for any customs duties, import taxes, brokerage fees or similar charges imposed by the destination country, unless expressly stated otherwise at checkout or required by applicable law.
Additional shipping information is provided in the Shipping Policy displayed at checkout.
6. Original artwork returns and right of withdrawal
Where applicable under mandatory consumer law, consumers purchasing goods online have a statutory right to withdraw from the purchase within 14 days after delivery, without giving a reason.
This statutory right does not mean that returns are offered free of charge.
The customer is responsible for the direct cost of returning an artwork when exercising the statutory right of withdrawal, provided that this obligation has been communicated before purchase.
The customer must notify the artist of the withdrawal within the applicable withdrawal period and must return the artwork without undue delay and, in any event, within the period required by applicable law.
6.1 Return procedure for original artworks
Because original artworks are unique, fragile and potentially irreplaceable, returns must be handled with particular care.
Customers must contact the artist before returning an original artwork.
The artist will provide the return instructions and the return address.
The customer must:
use appropriate protective packaging;
protect the artwork against impact, moisture, bending, scratching and other foreseeable damage during transport;
use a suitable tracked shipping service;
retain proof of shipment;
follow any reasonable packaging and shipping instructions provided by the artist.
The customer is responsible for taking reasonable care of the artwork while it is in their possession and for returning it safely in accordance with these instructions.
The customer must not send an artwork to an alternative address or arrange a return in a manner that has not been agreed with the artist.
6.2 Condition of returned artworks
The customer is entitled to handle an artwork only to the extent reasonably necessary to establish its nature, characteristics and functioning.
The customer is responsible for any diminished value resulting from handling beyond what is reasonably necessary to inspect the artwork.
Because original artworks are unique, even apparently minor physical damage may substantially affect their value.
Examples include, without limitation:
punctures or holes;
tears;
scratches;
paint damage;
stains;
deformation;
damage to the canvas, support, frame or stretcher;
moisture or water damage;
damage resulting from inadequate packaging.
Where an artwork is returned in a condition that has resulted in diminished value because of handling beyond what is reasonably necessary to inspect it, the artist may deduct the corresponding diminished value from the amount to be refunded, to the extent permitted by applicable law.
Where damage has caused a substantial or complete loss of the artwork's commercial value, the resulting diminished value may be substantial or equal to the artwork's value.
The artist may document the condition of artworks before dispatch and after return, including through photographs, video, packaging records and other evidence.
6.3 Refunds
Where a statutory withdrawal applies, refunds will be handled in accordance with applicable consumer law.
The artist may withhold reimbursement until the returned artwork has been received or the customer has provided evidence that the artwork has been sent back, whichever occurs earlier, where permitted by applicable law.
The artist is not responsible for the customer's return shipping costs where the customer is legally required to bear those costs.
Where the returned artwork has suffered diminished value as a result of handling beyond what was necessary to inspect it, the artist may make a corresponding deduction from the refund as permitted by law.
Nothing in these Terms & Conditions limits any mandatory consumer rights.
7. Faulty or damaged artworks
If an artwork arrives damaged, defective or otherwise does not conform to the contract, the customer should contact the artist as soon as possible and provide photographs of the artwork and its packaging.
The artist will handle such cases in accordance with applicable consumer protection law.
This section is separate from a customer's voluntary withdrawal because they have simply changed their mind.
8. Commissions and personalised artworks
Commissioned artworks are created specifically for an individual customer according to their requested specifications and/or personal requirements.
Commissioned artworks are governed by the separate Commission Terms agreed between the artist and the customer.
Where applicable law provides an exception to the statutory right of withdrawal for goods made to the consumer's specifications or clearly personalised, that exception may apply to commissioned artworks.
The specific terms applicable to a commission will be communicated to the customer before the commission is accepted.
9. Intellectual property and copyright
The purchase of an artwork does not transfer copyright or reproduction rights.
Copyright and reproduction rights remain with the artist unless expressly transferred or licensed in writing.
The customer may display the purchased physical artwork but may not reproduce, commercially exploit, manufacture copies of, or otherwise use the artwork as a source for reproduction without the artist's written permission.
10. Website use
The content of this website is provided for general information and artistic presentation.
Unauthorised copying, reproduction or commercial use of website content or artwork is prohibited.
11. Privacy
Personal data is processed in accordance with the Privacy Policy available on this website.
12. Cookies
This website may use cookies and similar technologies as described in the Cookie Policy.
13. Applicable law and mandatory consumer rights
These Terms & Conditions are governed by the applicable law of the seller's business, without prejudice to any mandatory consumer protection rights that apply to customers in their country of residence.
Nothing in these Terms & Conditions is intended to exclude or restrict any consumer right that cannot legally be excluded or restricted.
